John Cryer: To ask the Secretary of State for Work and Pensions what steps he is taking to improve standards of decision making at the Benefits Agency in response to the President of the Appeals Service report on Standards of Decision Making by the Secretary of State 2000-01. [27224] Mr. Nicholas Brown: This is a matter for Alexis Cleveland, Chief Executive of the Benefits Agency. She will write to my hon. Friend. Letter from Alexis Cleveland to John Cryer, dated 6 February 2002: The Secretary of State for Work and Pensions has asked me to respond to your recent Parliamentary Question asking what steps he is taking to improve standards of decision making at the Benefits Agency (BA) in response to the President of the Appeals Service Report on Standards of Decision Making by the Secretary of State 2000-01. The BA Board receives regular reports on Decision Making and Appeals standards at its monthly meeting and monitors the situation closely. The President's quarterly reports are seen by the BA Standards Committee who consider the Judge's observations when framing recommendations for BA Board for future improvement activities. In addition the BA has reviewed its procedures and has introduced measures to more closely align the consideration of the President's conclusions alongside its processes for handling recommendations from other groups, such as Internal Audit. Early evaluation following the introduction of Decision Making and Appeals, and research undertaken by the Standards Committee, confirmed the need to review the training available to support Decision Makers. Refresher training on Decision Making and Appeals principles has therefore been delivered and Training Services have re-designed two of their packages to support staff, Appeals presentation and Appeals preparation. Both packages reinforce the need to reconsider a decision where new evidence has come to light or errors have been found. The training builds on products developed locally by trainers and has undergone extensive quality assurance by a range of key stakeholders and is one of a series of products designed to support Decision Makers in the BA. The resulting new products were distributed to delivery staff in October; others are planned for introduction later in the year. An internal review covering the quality of decision making, guidance and training available following the introduction of these measures is currently underway. The BA Board will consider any further recommendations for improvement as a result of the review. In conclusion, many decision errors are purely procedural and do not effect the correct level of payment being made to the customer. However, the BA takes all decision making errors seriously and is taking positive action to address the issues raised. I hope this is helpful.

Letter from Alexis Cleveland to Mr. Steve Webb, dated 12 December 2001: The Secretary of State for Work and Pensions has asked me to respond to your Parliamentary Question asking what impact the heightened security measures in place in Government and Civil Service offices since 11th September have had on the operation and accessibility of benefits agencies for claimants; and if he will make a statement. Following the attacks of 11 September, security was heightened in Benefits Agency (BA) offices. Security guards were instructed to search all baggage when customers visited BA sites. There have been no formal or informal complaints from customers about this action. There has been no disruption to service to customers in Employment Services offices. There have been 12 incidents that have disrupted the operation of BA public caller areas. These have been for varying lengths of time, but on average the disruption lasted 2-3 hours. One of these incidents resulted in the public caller area being closed all day and customers were diverted to another nearby BA office. Feedback from Group 4, who provide security services for the BA, is that they have not been notified of any incidents or complaints, and generally BA customers have been very understanding and co-operative. Although BA offices implemented the search process, customers should not have received any disruption to normal service because of this. This search process has now reduced with security guards now checking baggage on a random basis. I hope this is helpful.

Letter from Alexis Cleveland to Annabelle Ewing, dated 16 November 2001: The Secretary of State for Work and Pensions has asked me to respond to your recent Parliamentary Question asking if he will list the procedural steps for assessing eligibility, reviewing, appealing and making payment of (a) severe disablement allowance (b) maternity allowance (c) industrial injuries disablement allowance (d) reduced earnings allowance/retirement allowance (e) attendance allowance and (f) disability working allowance, indicating which of the offices of his Department and his agencies in Scotland handle each of these steps. Information is not available about Disability Working Allowance as this was replaced by the Disabled Person's Tax Credit in October 1999, and is now administered by the Inland Revenue. Details of eligibility and payments for the other benefits listed have been placed in the House of Commons Library. The revision and appeals process is the same for all benefits. When an appeal is received in the Benefits Agency (BA), the Decision Maker considers whether there are any new grounds raised that would enable the decision to be revised. If not, a written submission is prepared and it and copies of the evidence are sent to The Appeals Service. At the same time a copy of the submission and the evidence is sent to the appellant and any known representative. The appellant is also sent a pre-hearing enquiry form to complete and return to the Appeals Service to indicate whether he/she wants his/her appeal to be dealt with by an oral or paper hearing. On receipt of the appeal submission and documents, the appeal is registered by the Appeals Service. When the pre-hearing enquiry form is received from the appellant, the appropriate type of hearing is arranged. Where an oral hearing has been requested, the panel member(s) who will form the appeal tribunal are allocated according to type of appeal and all interested parties (appellant, representative and BA) are notified of the date, time and place of the hearing. The panel members who form the appeal tribunal are independent of the Department for Work and Pensions and are appointed by the Lord Chancellor. When they have made their decision, all interested parties are notified. If the appeal tribunal finds in the appellant's favour, the BA is then responsible for implementing the tribunal's decision. The actual average clearance times for Attendance Allowance (AA) reviews between April 1997 and September 2001 are shown in the attached table. Please note that under the Decision Making and Appeals (DMA) procedures introduced in October 99, the review process changed in some respects and was henceforth termed reconsiderations. Reconsiderations occur when a claimant asks for a claim to be looked at again within one month of the previous decision. The DMA procedures introduced in 1999 led to temporary backlogs of work, and taken with a growing caseload for disability benefits, the average time taken to reconsider claims increased very significantly. These backlogs were tackled as a priority and the average clearance time for reconsiderations is now significantly lower. Letter from Alexis Cleveland to Mr. Andrew George, dated 22 October 2001: The Secretary of State for Work and Pensions has asked me to reply to your recent Parliamentary Question asking what training was given to his Department's staff with regard to the regulations under the Social Security (Incapacity Benefit) Miscellaneous Amendment Regulations issued on 22 November 2000 before they came into effect. Two training events were developed to support the introduction of the Incapacity Benefit Reforms. A three and a half day course, aimed at all staff who administer and process claims to Incapacity Benefit, was designed and developed centrally and delivered locally through the District Office Training Officer network. This event examined in detail the changes affecting the treatment of Incapacity Benefit claims and provided practice cases to consolidate trainees' learning. A further event, a half-hour question and answer brief, again developed centrally, was delivered to all other staff by either local line management or training personnel. This product provided awareness of the Incapacity Benefit changes and was aimed at those staff without any direct involvement in the administration of Incapacity Benefit. In addition to the training events outlined above, the detailed changes to Incapacity Benefits were also conveyed to staff through benefit specific circulars. I hope this is helpful.

Whilst the above figures may include complaints about the administration of the Attendance Allowance, it should be noted that they also include general expressions of disagreement with the amount of benefit awarded. Disputes of this nature must be pursued through the decision making and appeals process. You will be aware from my reply of 10 April 2001 to your previous Parliamentary Question about Disability Living Allowance complaints that they were subject to a steady increase arising from a temporary backlog of work following the introduction of new decision making and appeals procedures. Attendance Allowance claims and subsequent complaints were similarly adversely affected but, as with Disability Living Allowance, the backlog of work has now been cleared and the overall level of complaints has reduced since August 2000.
