This was a complex contract, and there was a standard process to compare the bid assumptions with the actual and detailed scope of the work that needed to be delivered. The decision to terminate the contract with Cavendish Fluor Partnership was made by the Nuclear Decommissioning Authority Board on 20 March 2017 and received ratification from the Accounting Officer, my Rt Hon Friend the Secretary of State the Secretary of State for Business, Energy and Industrial Strategy and Chief Secretary to the Treasury on 26 March 2017.

The Nuclear Decommissioning Authority’s (NDA’s) decision to terminate the contract with Cavendish Fluor Partnership, subsequently ratified by my Rt Hon Friend the Secretary of State for Business, Energy and Industrial Strategy and the Chief Secretary to the Treasury, was due to the significant mismatch between the work that was specified in the contract as tendered in 2012 and the work actually required. The decision to terminate was entirely separate and independent from the NDA’s decision to settle with Energy Solutions and Bechtel, and was handled as such. This separation was made clear in my Rt Hon Friend the Secretary of State’s remarks to the House on 27 March 2017.

Following the 29 July 2016 High Court judgement, the government increased its scrutiny of large and high-risk NDA projects, drawing on the expertise of the Infrastructure and Projects Authority in particular. In parallel, and following discussions with government, the NDA also introduced a new ‘Projects Committee’ within their internal governance, increasing the Board’s oversight and assurance of important programmes.

In line with the Nuclear Decommissioning Authority (NDA) Framework Document, my Rt Hon Friend the Secretary of State for Business, Energy and Industrial Strategy holds regular meetings with the NDA covering the breadth of its decommissioning work. The decision to terminate the contract with Cavendish Fluor Partnership was made by the NDA Board on 20 March 2017 and received ratification of the Accounting Officer, the Secretary of State and the Chief Secretary to the Treasury on 26 March 2017.

The Nuclear Decommissioning Authority’s (NDA’s) contract with Cavendish Fluor Partnership (CFP) contains a provision to allow for a period of consolidation between the NDA and CFP, ensuring the contract is in line with delivery on the ground.
The NDA’s consolidation process has not yet concluded and therefore it is not appropriate to comment on this figure.

Under current plans, all Magnox sites will be rendered passively safe with the reactor structures in safe stores by 2028. Final clearance of the sites is planned from around 2080 onwards. End dates for the Magnox sites are published in the Nuclear Decommissioning Authority’s Strategy document. Annual expenditure at the Magnox sites is forecast to vary significantly over the duration of the decommissioning programme and is expected to decrease as the reactor structures move into safe store.

This Department has not had any discussion with the Department of Energy and Climate Change (DECC) about the Nuclear Decommissioning Authority’s (NDA) competition to secure a new parent body organisation for Magnox Ltd and Research Sites Restoration Ltd. The NDA ran the competition in strict accordance with UK and EU procurement regulations. Oversight and governance of the process was provided by the NDA’s Competition Programme Board. The Government is represented by the Shareholder Executive (on behalf of DECC), HM Treasury and Infrastructure UK.
