The government recognise that the home buying and selling process in England and Wales is inefficient and costly for consumers and professionals. We continue to review evidence from other jurisdictions, including on reservation agreements, as we consider next steps.

The government remains committed to improving the home buying and selling process. We are working with industry to ensure potential buyers have access to the critical information they need to know – including tenure type, lease length and service charges – in an accurate and timely digital format.  This will help them to make informed decisions about whether to purchase a property, reducing the likelihood of the sale falling through. We will provide further details on our plans to reform the home buying and selling system in due course.

Earlier this year, we signalled our intent in the Levelling Up White Paper to work with industry to improve the home buying and selling process.
Whilst specific policy proposals will need to come forward as part of that initiative, we are now in the process of developing a more detailed plan and will draw upon previous collated research, analysis and data to inform our approach.

We commissioned some behavioural insight specialists to work with consumers and industry bodies to explore ways to encourage the adoption of voluntary reservation agreements. Under these agreements, buyers and sellers would make a legal commitment to proceed with the sale once an offer has been accepted and may include a financial commitment which would be surrendered to the other side if the party withdraws without good reason. We are currently evaluating the findings and will then make a decision about the next steps.

The Government is committed to improving the home buying and selling process in order to make it quicker and less stressful. We recognise that on occasions, buyers can lose a property because they are 'gazumped' by the seller accepting a higher offer from another buyer.
To mitigate this risk, we have been exploring the adoption of voluntary reservation agreements. Buyers and sellers would make a legal commitment to proceed with the sale once an offer has been accepted and may include a financial commitment which would be surrendered to the other side if the party withdraws without good reason such as gazumping.
In order to be widely taken up, reservation agreements need to be attractive to buyers and sellers, and promoted by estate agents and legal representatives. Following behavioural insight research, work is now continuing to develop the agreements to make them an effective tool in improving the efficiency of home buying and selling and we hope to be able to evaluate their effectiveness next year

We would like home buyers and sellers to be able to transact with more confidence. It is for this reason that we are working with industry to develop and trial reservation agreements. These legal agreements would be entered into by both parties at the point of offer and there could be financial penalties if a party withdrew without good reason. We hope to proceed to a trial later this year.

The Government explored this in our consultation on improving the home buying and selling process during which the most common response to the question on gazumping was for buyers and sellers to commit earlier in the process.
Informed by this consultation, we are now working to increase the use of reservation agreements to support buyers and sellers to commit earlier in the home buying and selling process and reduce the rate of failed transactions, which currently stands at over 25 percent. In particular we are working with industry to develop a standardised reservation agreement and we are going to commission behavioural insight analysis to support their implementation.

The Government has committed to working with the sector to develop a standardised reservation agreement for use by buyers and sellers which will be informed by behavioural insights analysis. There are many different contractual arrangements buyers and sellers of property can enter to help manage risks and uncertainty in the process. They all entail different levels of risk, costs and benefits to both parties. The Government supports free, independent advice and guidance for consumers, through its funding of Citizen’s Advice, across a wide range of issues. However, ultimately matters such as conveyancing contracts should be discussed with a buyer or seller’s solicitor who can advise on the best approach an individual could take, should they wish to do so, according to their circumstances.
