Waste Management: Solutia Bankruptcy

- asked Her Majesty's Government:Why no proofs of claim against Solutia Inc were ever filed by lawyers representing United Kingdom interests in the United States Bankruptcy Court on the basis of evidence that was available in 2004.

The Environment Agency filed no proof of claim in the US Bankruptcy Court, as it had no crystallised claim against Solutia Inc for environmental remediation of Brofiscin Quarry and/or other UK sites. The Environment Agency is still investigating potential appropriate persons pursuant to its duties under Part 2A Environmental Protection Act 1990, in order to determine responsible parties and the extent of any prospective claims.
