Terrorism Bill
I follow the Minister’s argument and I am in some sympathy with it. But can she deal precisely with the issue of the burden of proof which has been raised by the noble Lord, Lord Kingsland? ““More likely than not”” is a phrase that we do not particularly like in criminal law. Added to that, is there a precedent for this kind of statutory implementation?
