Terrorism Bill
We believe that the burden lies with the prosecution—appropriately, under the new subjective test—and that no further changes are necessary at the moment. The standard is beyond reasonable doubt. It is relevant to all elements of the offence in Clause 1. The prosecution must prove all those elements of the offence beyond reasonable doubt and that it is likely to be the effect of the statement.
