Proceeding contribution from Viscount Hailsham (Conservative) in the House of Commons on Thursday, 19 October 2006. It occurred during Debate on bill on Companies Bill (HL).
Companies Bill [Lords]
I am listening to the hon. and learned Lady, but can she help us with the claims of depositors with respect to banks? If a bank goes bust and the auditor should have picked up the fact that money was being filched by bank employees, but does not, what happens to the depositors? Does a liability limitation agreement pre-empt or prevent the depositor from being able to maintain a claim against the auditor?
