The noble Lord said: My Lords, I thank the Minister for what he has said. I still do not understand why it is not possible to move the penalties for abusing a level crossing up the scale. I am sure that the level of penalty available determines what the courts decide: they have the freedom to use that. Therefore, I should like to seek the opinion of the House on this issue.
