98: Clause 35, page 18, line 32, at end insert— "(1A) This section shall only apply to the provision of infrastructure which (in the opinion of the Minister) may pose a significant risk to the undertaker’s ability to carry out its duties. (1B) In exercising an assessment of risk as set out in subsection (1A), the Minister must have regard to— (a) the financial commitment of the infrastructure provision compared with the turnover of an undertaker, and (b) the technical complexity of the provision of infrastructure."
