[54156] Mr. Meacher: I am today placing in the Library a copy of the Government's consultation document on amendments to the Producer Responsibility Obligations (Packaging Waste) Regulations 1997. The consultation document puts forward a number of options and proposals for modifying the Regulations and many of those reflect the recommendations made at the end of June by the Advisory Committee on Packaging (ACP), chaired by Sir Peter Parker. The ACP undertook a review of the Regulations in the first part of this year and have, in particular, advised that, at this early stage, adjustments to the Regulations should be kept to the minimum in order to minimise uncertainty, and encourage investment in the collection and reprocessing infrastructure for packaging recycling and recovery. The Government also need to be assured that the requirements of the Regulations will be sufficient to enable the UK to meet the targets in the EC Directive on Packaging and Packaging Waste in 2001. The options and proposals in the paper are therefore designed to ensure the smooth working of the Regulations in order to meet our objectives. The document invites views on the options presented for changes to the Regulations. Decisions on any changes to the system will be made on the basis of the views received in response, and will of course be subject to Parliamentary approval later in the year. Hon. Members may wish to note that this document is relevant to a number of the issues that were raised by the Environment, Transport and Regional Affairs Committee in its Sixth Report, Substantial Waste Management. The Government are preparing a full response to the Committee's recommendations, including those relating to the management of packaging waste, and hope to publish it shortly.

[49070] Mr. Meacher: I am today placing in the Library a copy of the Advisory Committee on Packaging's Report on the operation of the Producer Responsibility (Packaging Waste) Obligations Regulations 1997. The Committee's principal conclusion is that adjustments to the Packaging Regulations should be kept to the minimum in view of the very short timescale for achieving the Directive targets set for 2001, the costs to business and the need to encourage investment in the expansion of recycling and collection capacity. Sir Peter Parker's report includes specific recommendations on the PRN system: in particular, that the PRN mechanism should be more transparent to assure all parties that the funds raised are deployed effectively to increase collection and reprocessing capacity; and that the PRNs should be issued to obligated producers or their representatives only. The report recommends the development of a national packaging planning framework to give the parties involved greater confidence in planning on the achievement of the packaging waste recovery targets, and to contribute to the national Waste Strategy. The Committee also recommends that there should be mechanisms developed to promote cost pass through by the various sectors, but that where this fails, "hardship criteria" should be established to determine where a case merited review. Clearly this is still a relatively early point in the operation of these Regulations which are based on an inter-sectoral industry agreement, and I am keen that the Government should continue to have the benefit of the Advisory Committee's views on such issues as may arise in this challenging period as we seek to double the UK's packaging recycling activity. I will be discussing with Sir Peter how the Committee can continue in this valuable role.

Mr. Matthew Taylor: To ask the Secretary of State for the Environment, Transport and the Regions what action he is taking to help local authorities to meet the waste recycling targets of (a) 60 per cent. reduction of wastes going to landfill by 2005, (b) recovery of 40 per cent. of municipal waste by 2005, (c) 25 per cent. household waste recycled by 2000 and (d) 75 per cent. of local authorities actively promoting composting by 2000. [38616] Angela Eagle: Our prime aim is to move waste management up the waste hierarchy--reduction, re-use, recovery (which includes composting, recycling and energy from waste), and finally disposal--having regard to the Best Practicable Environmental Option (BPEO). On the national targets mentioned by the hon. Gentleman, we have taken the actions set out below. (a) The target in the previous Government's White Paper "Making Waste Work" is to reduce the proportion of controlled waste going to landfill to 60 per cent. by 2005. The landfill tax is the main tool we have for reducing the amount of waste going to landfill and the increase in the standard rate of tax (for active waste) from £7 to £10 per tonne, which takes effect from April 1999, will build on the reduction that has already taken place since the introduction of the tax. The same proportion-- 20 per cent.--of additional revenue generated by this increase will be available for distribution to environmental bodies as is the case for funds under the current scheme. The Government will also be considering whether the environmental bodies scheme could be enhanced, and in particular examining how it could be used to encourage more recycling. Under the United Kingdom's presidency of the European Union, a Council Common Position has been agreed on the draft landfill directive, which would entail substantial reductions in the landfill of biodegradable municipal waste. (b) "Making Waste Work" also set a target of 40 per cent. recovery of municipal waste by 2005. We have accepted all of the recommendations of the cross-sectoral Review Group on the Role of Local Authorities in Recycling, one of which was that Waste Disposal Authorities and Waste Collection Authorities should work together to formulate integrated municipal waste management strategies. Such a strategy would bring into play all the various ways of dealing with waste-- composting, recycling, energy from waste and final disposal. With the increasing cost of final disposal to landfill, I would expect waste management options further up the hierarchy to play a more important role in an integrated waste management strategy than they do at present. Composting, recycling and energy from waste all count towards this national recovery target. The Department has recently issued guidance to local authorities on revising their recycling plans and strategies. The emphasis in the guidance is very much on authorities working together towards integrated municipal waste strategies, of which we expect waste collection authorities' recycling plans to form an integral part. The Packaging Regulations will also have an important role to play in meeting this target. The Producer Responsibility Obligations (Packaging Waste) Regulations 1997 were introduced by the previous Government and reflect a shared approach agreement between business sectors as a means of implementing the EC Directive on Packaging and Packaging Waste. These Regulations are a first step towards changing attitudes in industry and in society more generally towards consumption, disposal and recycling. The targets in the Regulations are staggered in such a way that will allow the UK to meet the Directive targets as required in 2001, that is that at least 50 per cent. of packaging waste be recovered each year from 2001 and thereafter, and at least 15 per cent. of each material be recycled. The Regulations are currently being reviewed by the Advisory Committee on Packaging. Among the matters under consideration is the scope for strengthening the local authority role. The Committee is to report at the end of May. Consultation on any proposed changes to the Regulations will take place in the summer. (c) As far as the target of recycling 25 per cent. of household waste is concerned, we do not now expect it to be met. However, it needs to be recognised that some local authorities are already recycling 25 per cent. of their household waste, although others only manage less than 3 per cent. The important thing is for those authorities with lower recycling rates to benefit from the experience of those achieving higher rates, and to this end the Department is currently undertaking a Good Practice project, which will disseminate to all authorities the good practice of, and lessons learnt by, about forty authorities. (d) "Making Waste Work" contains targets on composting, including for 1 million tonnes of organic household waste a year to be composted by 2001. This administration is keen to increase the quality and quantity of municipal waste which is composted. One of the main barriers to centralised composting is the lack of markets for the end product. In November last year we issued guidance to local authorities on designing and marketing their compost to large-scale users, mainly in the horticultural and landscaping industries. At the same time, we issued guidance to a wide range of prospective users in those sectors on the benefits of specifying waste-derived compost. We have also set up a Composting Development Group to identify the problems and obstacles of marketing waste-derived composts to the agricultural, land restoration, landscaping and horticultural sectors, and to develop proposals to help overcome them. The Group is due to report in the summer.

Mr. David Martin: To ask the Secretary of State for the Environment if he has considered the responses to the consultation paper he issued in July on the Producer Responsibility (Packaging Waste) Regulations; and if he will make a statement. [10475] Mr. Gummer: Together with my colleagues the President of the Board of Trade, and the Secretaries of State for Scotland and for Wales, I published proposals in July which aim to secure an effective business led approach to meeting the environmental goal of a more sustainable approach to packaging waste. This followed a lengthy process of consultation with a wide range of business sectors and is based on the industry agreement on the shared approach achieved on 15 December 1995. The system we propose is based on four guiding principles: using the market to reflect the cost of dealing with waste in the price the consumer pays; a shared approach involving all parts of the packaging chain; the lightest regulatory approach giving the maximum scope for obligated businesses to self-certify and self-assess their obligations and to perform those obligations through business run schemes, or individually subject to monitoring by the environment agencies. continuing industry involvement in monitoring, reviewing and proposing changes to the system through the Advisory Committee on Packaging. We have had a wide range of responses to the consultation paper including 100 from trade associations representing 53,000 member businesses and a further 348 from individual businesses and, other interested organisations. Most respondents endorsed the overall framework and the basic provisions which flow from the 15 December agreement. However, the responses did raise specific concerns on issues such as timetable, the level of interim targets, the cut-off threshold for small businesses, the wholesaler obligation and the scope and nature of exemptions. I have considered these and have sought the views of Sir Peter Parker and the Advisory Committee for Packaging and I am grateful to have their further comments which will be published separately. I therefore intend to make the following modifications to the draft regulations which will be subject to parliamentary debate. To allow businesses sufficient time to assess the implications of the regulations for them and the merits of joining a collective business scheme such as VALPAK, I propose to delay the first requirement for registration and provision of data until the summer of 1997 and I will make a further announcement shortly. The date for the renewal of registration and the provision of data will, from 1998 onwards, be 1 April. A further concern raised related to the proposed interim targets for recovery and recycling which could place an unnecessarily high burden on some businesses and particularly on those who handle materials which are harder to recover. Many felt that a slower build-up to the full directive targets in 2001 targets would be more realistic. I therefore propose to revise the interim targets on individual businesses as follows: _________________________________________________________________________________________________. Minimum recycling target for Overall recovery target Recovery of UK packaging waste each material 1998-99 7 38 32 2000 11 43 40 2001 16 {1}52 50 _________________________________________________________________________________________________. {1} Of which a minimum of 26 per cent. must be recycling. These targets will enable the UK to meet the recycling and recovery targets set out in the EC directive on packaging and packaging waste, 94/62 EC. I have also taken account of the representations that some sectors of industry will have greater difficulty in adapting to the proposed obligations than others, particularly in the case of small firms. I also consider that the most effective means of introducing the new system will be to take a staged approach starting with the largest businesses. I therefore propose to adopt a phased approach in relation to the following aspects: No business with a turnover of less than £5 million, or that handled less than 50 tonnes of packaging will have an obligation in the years 1997 to 1999, but from 1 January 2000 an eligible business with a turnover of £1 million or more and that handled more than 50 tonnes of packaging will be obligated. The proposed wholesaler obligation will apply from 1 January 2000. I am confident that a phased approach will allow these sectors additional time to prepare and work up methods for meeting recycling and recovery objectives in a form which meets their needs. I have considered also issues raised by those who handle packaging which is or is associated with special or hazardous waste. Where packaging is likely to become special waste, producers will not need to include it when calculating their recovery and recycling obligations, but they will need to provide data and indicate the steps taken to promote or increase its recovery. This amendment should assist those producers that handle packaging whose hazardous or contaminated nature require special disposal arrangements. I also propose to place an obligation on production of reusable packaging but to exempt it when it is reused. Other more detailed changes will be set out in the published regulations. I also recognise that for many businesses a major concern is not the recycling and recovery effort itself but the means of gathering data. Some businesses already have good data systems while many trade associations and the Industry Council on Packaging and the Environment are already working to develop sector guides and assistance with definitions and other guidance. I intend to support this work and to make available, to help to start the system, a very simple ready reckoner which businesses can use to meet the initial requirement for a best estimate expressed in tonnes per annum. The environment agencies who will monitor and enforce the regulations will charge a fee to individual businesses and collective schemes to cover the costs of their functions. In the light of consultation, and taking account of the changes listed above I purpose to set the fee for individual businesses at £750 per annum and to offer schemes a rebate of up to 87 per cent. of this according to the size of their membership. The advisory committee is continuing its work on implementation of the system and is currently considering matters relating to evidence of compliance and recent representations it has received on the issue of equitable participation in household waste recovery. It is also preparing for its review of the system as a whole. On these and other issues, it will publish its findings as appropriate and I am fully committed to supporting its continuing role.

Mr. Anthony Coombs: To ask the Secretary of State for the Environment what is the role and purpose of the advisory committee on packaging.[28882] Mr. Gummer: In the answer that I gave to my hon. Friend the hon. Member for Eastbourne (Mr. Waterson) on 7 May, I set out some of the background to the Government's decision to follow a shared approach as the basis for regulations which would give effect to the producer responsibility initiative and to the EC directive on packaging and packaging waste. Continuing partnership with industry is critical to success in this area and following the agreement reached on 15 December, I have asked Sir Peter Parker to chair an advisory committee on packaging comprising some of the senior business representatives most closely involved in this initiative. The external members of the committee are: Sir Peter Parker KBE LVO: Chairman Dr. Bill Cook: British Gas Mr. Brian Curtis: CarnaudMetal Box--Foodcan UK Mr. Peter Lipscomb: Guinness plc Mr. John Longworth: Tesco plc Mr. John Turner: Coca-Cola Schweppes Beverages Mr. Keith Stenning: British Polythene Industries plc Mr. Peter Williams: David S. Smith (Holdings) plc Mr. Martin van Zwanenberg: Marks & Spencer plc For its initial work the committee is supported by a technical working group of experts with particular experience of packaging and related issues. In addition to the work it has already undertaken, the committee will continue to provide guidance on the introduction and implementation of regulations, based on the 15 December agreement, and will advise me, the President of the Board of Trade, the Secretaries of State for Scotland and for Wales, the chairman of the Environment Agency and the chairman of the Scottish Environment Protection Agency. The committee will advise on the effectiveness of regulations in delivering the EC directive targets and will help to monitor their operation. In particular, it will advise on arrangements for carrying out a review of the legal obligation, in the light of data submitted after the regulations have come into force, including consideration of the actual burden on individual companies. In carrying out its work, the committee will keep in mind the Government's tests for the approach to legislation as set out in the Official Report on 2 February 1995, columns 762-64, the requirements placed on the Secretary of State by the enabling powers in the Environment Act 1995 and Ministers' emphasis on the desirability of maintaining a consensual approach for the development of an effective business-led initiative for the recovery and recycling of packaging waste in the UK. I am grateful for the work already carried out by Sir Peter Parker and members of the advisory committee and the supporting technical group. I intend to publish the committee's preliminary advise to accompany the issue of draft regulations for consultation and at appropriate stages in the future.
