I have added my name to Amendments Nos. 27A and 28 on the belt-and-braces principle. The noble Earl has pointed out some interesting effects of the Bill and spoken of the unintended consequences of the Bill as presently drafted. He asked how the measure would be enforced. He was talking about aircraft, but how will it be enforced with regard to car drivers? When the police see a car going by with someone in the front they believe to be smoking, that person might actually be holding a biro or something, but at high speed the police may mistake it for a cigarette. Will there be high-speed car chases along the M1 with people being pulled up and forced on to the hard shoulder to be asked if they can provide proof that theirs is a private car, not a company car? The idea is ridiculous.
