Companies Bill [Lords]
These decisions would not be taken day in, day out. One of the important aspects of the proposal is that it would be used only rarely and sparingly. There are also policy matters behind the proposal, as has been revealed in the debate. As I have said, it is a close judgment as to whether a court or the Secretary of State should make these decisions, but on the whole, I believe that the Secretary of State is in a better position to make them, subject to judicial review. The proposal is far more narrowly drawn than the one that we discussed in Committee, and it meets a specific need. The provision in the Bill is good, but it is not quite enough. I urge the House to support the new clause.
