99A: Schedule 5, page 19, line 25, at end insert— ““NOTE 1 Section 21(2)(a) does not apply to an order under section 5 which provides for— (a) functions of the British Waterways Board falling within section 21(3)(b) to (e) to be transferred to another person; (b) functions of the Environment Agency falling within section 21(3)(b) to (e) to be transferred to a person to whom functions of the British Waterways Board are transferred by virtue of paragraph (a).”” Amendment 99A agreed.
