Section 77 of the School Standards and Framework Act 1998 requires local authorities to obtain the consent of the Secretary of State
before selling any playing fields which:
(a) are used by a maintained school for the purposes of the school, or
(b) have been used at any time within the last 10 years.
Applications to dispose, or change the use, of school playing fields are assessed against the following criteria:
i. schools' needs: that playing field provision and curriculum requirements at the school making the disposal, and at other schools
in the local area, will be met;
ii. community needs: that community use of a school's playing fields is taken into account, with alternative facilities made
available if necessary;
iii. finance: that any sale proceeds are re-invested to provide new or improved sports facilities at schools, or are used to help to
raise standards by providing better educational facilities.
Only those applications that meet the criteria are approved. Since July 2001, all applications have been scrutinised by the
Independent School Playing Fields Advisory Panel to make sure that they comply with the published criteria. The Panel comprises
representatives from the National Playing Fields Association, the Central Council of Physical Recreation, the education organisation
Learning through Landscapes, the National Association of Head Teachers and the Local Government Association.

Mr. Robertson: To ask the Secretary of State for Education and Employment what is the procedure which must be followed by local
education authorities before closing special needs schools; who makes the final decision in such instances; and if he will make a
statement. [105577]
Jacqui Smith: [holding answer 19 January 2000]: A local education authority wishing to close a special school must first consult all
interested parties, including the school itself, parents who have children at the school and any other local education authorities
placing children at the school. If, after consultation, the local education authority decide to proceed with closure they must
publish notices advising of their intention and providing information about alternative provision to be made for pupils who would be
displaced by the closure. The notice must also be sent to whomever will be deciding the proposals. Usually, this will be the local
School Organisation Committee; exceptionally, where a local School Organisation Plan has not been agreed, the decision will fall to
the Secretary of State.
Following publication of a proposal there is a statutory period during which anyone can send objections to the proposal to the local
education authority. The authority then have a further statutory period in which to send their comments on the objections to the
School Organisation Committee (or the Secretary of State). The School Organisation Committee's decision on statutory proposals, or
that of the Secretary of State, is final. However, in cases where the School Organisation Committee cannot reach a unanimous view,
the proposal must be referred to an independent adjudicator for decision.

Ms Estelle Morris: Direct comparison cannot be drawn between local authorities' estimated expenditure on management and
administration for 1998-99 and their estimated expenditure on strategic management for 1999-2000 in view of the very different
definitions set down in regulations. Figures extracted from the statements for 1998-99 prepared under section 122 of the Education
Act 1996 and for 1999-2000 prepared under section 52 of the School Standards and Framework Act 1998 are provided in the following
table.

Mr. Laurence Robertson: To ask the Secretary of State for Education and Employment if he will make a statement on the differences
between spending shown in local education authorities' section 52 statements and that shown in their section 122 statement for
1998-99 which are attributable to the existence of grant maintained schools. [89745]
Ms Estelle Morris: Estimated expenditure on schools which were grant maintained in the financial year 1998-99 was not required to be
included in budget statements prepared by local education authorities under section 122 of the Education Act 1996 since these
schools were funded direct by the Funding Agency for Schools. Budget statements prepared under section 52 of the School Standards
and Framework Act 1998 cover estimated expenditure for the financial year 1999-2000. Whilst grant-maintained status remains until
the end of August, local education authorities have been responsible for passing on funding to these schools since 1 April and
section 52 statements include the full year's funding, together with any transitional protection to which individual schools may be
entitled.

Ms Estelle Morris: The local schools budget and individual schools budget are being introduced for the financial year 1999-2000.
Local education authorities are currently in the process of submitting details of their budget proposals for 1999-2000 to the
Department. I will write to the hon. Member when the figures he requests are available, and a copy of my letter will be placed in
the Library. These figures will also be published in the next few months, alongside tables showing the level of each local education
authority's expenditure on its schools.

Ms Estelle Morris: Local eduction authorities are required to publish their budget statements and to notify schools of their budget
shares before the beginning of the financial year to which they relate. The following local authorities published their budget
statements for the 1999-2000 financial year by the appointed time:
Barnet
Brent
Brighton and Hove
Kingston-upon-Hull
Kingston-upon-Thames
Redbridge
Southend
South Gloucestershire
Trafford.
Information about the dates on which local education authorities notify their schools of their budget shares is not collected
centrally.

Mr. Laurence Robertson: To ask the Secretary of State for Health how many local education authorities send head lice nurses into
schools; what is his Department's policy on head lice nurses in schools; what is the cost of providing head lice nurses to schools;
and if he will make a statement. [78941]
Ms Jowell: It is the responsibility of health authorities to provide services to control the spread of head lice among school
children. This service is exercised through the primary health care team, which may include the services of a school nurse. It is
the policy of the Department together with the Department of Education and Employment, to encourage a "whole school approach" to the
detection of and treatment of head lice. This entails parents checking their children and other family members for head lice and
arranging treatment where necessary, with such support from the local primary health care team as they may require.
Information on the number of school nurses checking for head lice and the cost of this service is not available centrally.

Mr. Laurence Robertson: To ask the Secretary of State for Education and Employment what factors are taken into account when
classifying children as having moderate learning difficulties; what plans he has to review the statementing system; and if he will
make a statement. [61502]
Mr. Charles Clarke: The Code of Practice on the identification and assessment of special educational needs includes guidance on the
factors to be taken into account in deciding whether a child with learning difficulties should be given a statement. These include
whether the child is working at a level significantly below his contemporaries in any of the core subjects of the National
Curriculum; whether there is evidence that the child is falling progressively behind the majority of children of his or her age in
academic attainment; whether there is evidence of impaired social interaction or communication; and whether the child has a
significantly restricted repertoire of activities, interests and imaginative development. The recent publication "Meeting Special
Educational Needs: A programme of action" makes it clear that the Government have no intention of removing the legal protection
offered by statements or of constraining parents' access to a statutory assessment where they believe it is necessary. There are
however wide variations between LEAs in making statements. The Government therefore propose to publish non-statutory guidance on
criteria for statements drawing on a range of examples of current practice.
