Proceeding contribution from Lord Myners (Labour) in the House of Lords on Tuesday, 13 January 2009. It occurred during Committee of the Whole House (HL) and Debate on bill on Banking Bill.
Banking Bill
I believe that the example I gave is drawn from the code, but the code is a long and complex document; I have a copy with me, but it would delay the Committee if I were to seek to find the quotation. If I do, I will ensure that that is drawn to the noble Baroness’s attention. If it is not in the code, it strikes me as an example that should be—and of course the code is an evolving document. Noble Lords will appreciate that I do not have a legal background, but I place emphasis on the words ““as appropriate”” in Clause 4(9). The objectives are not listed in this section in any particular order. That is important, because circumstances will be different and they are to be balanced as appropriate in each case. There is a very clear message from the noble Baroness, Lady Noakes, with which I am entirely comfortable: that it is difficult to envisage a situation in which it would be appropriate to override convention rights within the Human Rights Act 1998. However, there are circumstances in which it would be appropriate to take them into consideration and others where they would simply not be relevant and therefore not appropriate.
