My Lords, perhaps the Minister would confirm that an immigration officer or a customs officer is entitled to hold someone for three hours, which was my clear understanding. Perhaps no one here can help us. Section 2(1)(a) of the UK Borders Act, referring to detention, says, ""may be liable to arrest by a constable under section 24(1)"." That is all the Police and Criminal Evidence Act goes on. Then it says that a designated immigration officer who detains an individual, which is what we are talking about, can hold for three hours.
