Proceeding contribution from Lord Bradshaw (Liberal Democrat) in the House of Lords on Monday, 5 December 2005. It occurred during Debate on bill and Committee proceeding on Civil Aviation Bill.

Civil Aviation Bill

moved Amendment No. 14:"Page 3, line 35, leave out ““may”” and insert ““shall””" The noble Lord said: The amendment is repeated four times in the Bill. Although the Marshalled List lists only three, there is another one further on. The amendment would take away from the managers of aerodromes, as they are called in the Bill, the discretion whether they establish and maintain a penalty scheme so that they will establish and maintain such a scheme. It should not be a discretionary power in any way—either on the part of the Secretary of State or the aerodrome operator—whether such schemes exist. We believe that such schemes ought to exist, because the making of noise and emissions is a very objectionable procedure. There should be a scheme for reducing noise and emissions, and each licensed aerodrome above a certain size should contribute to that process. The amendment simply seeks to draw from the Minister why this is a conditional ““may”” instead of an absolute ““will””. I beg to move.
